Redundancies & Reorganisation – Financial Services Sector

We acted for a FTSE 100 business on the reorganisation of one of its divisions, involving collective consultation on redundancies and mass changes to terms and conditions of employment.

Multi-Jurisdiction Outsourcing - Tech Sector

We acted for a large tech business which outsourced a number of its functions across the globe. We co-ordinated the Employment Law advice across 12 jurisdictions, ensuring the client had clear advice of the issues on each jurisdiction. This meant that the client was able to plan their process and timetable, managing their risk, and successfully completing the outsourcing. 

 

ET Claims – Retail Sector

Our client was a well known national retailer. We managed their varied ET caseload over many years. We streamlined processes, and built a simple risk assessment step into the process, which allowed the client to consider the risk in each case at the outset, and as it developed. Both the volume of claims and the cost of them reduced significantly over the years, saving the client millions of pounds on their People issues.

 

Equality and Senior Executives – Utilities Sector

We acted for a listed business in relation to a “me too” grievance by the CFO in relation to the CEO and non-exec chairman. The complainant initially threatened to go to the press with the complaints (at the height of the publicity of the Weinstein case) if the matter was not resolved to her satisfaction within 72 hours. The matter was resolved successfully for our client, within four weeks, and in that time we worked in conjunction with another leading law firm on the independent (and highly sensitive) investigation.

 

Business Protection – Financial Services Sector

We acted for a senior management team, looking to leave their existing business and set up a new business in competition. They had detailed restrictive covenants, and a complex Shareholders Agreement. Our advice included an initial consideration of the viability of the proposal. Having advised that the moves were possible, we devised a strategic plan for the exits and formation of the new business, and then advised throughout the implementation of the plan. The team successfully negotiated their exit and the formation of the new business, including the transfer of most of their existing clients. We successfully resisted litigation including threatened interim relief. Matters were resolved through mediation, with limited exposure for the client. The new business is now operating very successfully.

Boardroom Disputes - Utilities Sector

We advised a C-suite director on his exit from the UK subsidiary of a NYSE listed business.  We guided the individual through a complex exit process and negotiated the terms of a consultancy agreement concerning his ongoing role in relation to various matters, including a disposal valued at up to $400M.

 

Business Protection – Construction Sector

We acted for a global infrastructure business in relation to a team move to a competitor.  Initially, we sought and obtained an interim injunction and eventually pursued claims in respect of misuse of confidential information, breach of duties and unlawful means conspiracy.  The matter was eventually resolved on terms which were highly favourable to our client.

 

Investigation and terminations – Leisure Sector

Our client was a leading business in the leisure sector, with hundreds of outlets across the UK. They had serious concerns about certain practices, and financial irregularities. We conducted an initial high level investigation, to identify the likely areas of concern. We then conducted a detailed investigation across the business, and helped the client to manage the impact of this whilst allowing the continued functioning of operations. We reported to the client’s board, and made recommendations. Our recommendations were accepted, and we helped the client manage the resulting disciplinary processes, and terminations. All were completed without adverse issues, and the new management team were able to manage the business successfully through the disruption.
